At Erwin Hymer Group SE (hereinafter "EHG", "we" or "us"), we take the protection of your personal data very seriously. Your privacy is an important concern to us.
These Privacy Notices apply to the System Connect service, which is composed of:
a) the functionalities of the respective System Connect Unit contained in the vehicle for controlling the connected components,
b) the associated cloud service (hereinafter: "System Connect Cloud" or "Cloud Service") and
c) the software application or app (hereinafter "System Connect App" or "the App").
The System Connect Unit is available in two different versions:
a) As a System Control Unit (hereinafter "SCU"), it enables the user to execute the functionalities connected with the System Connect service within the vehicle.
b) As a System Information Unit (hereinafter "SIU"), it enables the user to retrieve various information from sensors in the vehicle that are connected to the System Connect service; there is also the option to connect additional sensors (where available).
The execution of vehicle component functionalities via the System Connect service is only possible with the SCU and not with the SIU.
These Privacy Notices also apply in connection with the System Connect App End User Licence Agreement (hereinafter "EULA") and the System Connect Terms of Use (hereinafter "Terms of Use").
Personal data within the meaning of this privacy notice comprises all information that has a reference to you as a user of the System Connect service.
The technical terms used in this privacy notice are to be understood as defined in Art. 4 GDPR.
"Controller" and "Responsible Party" are used synonymously.
Pursuant to clause 16.2 of the Terms of Use, or clause 14.1 of the EULA, the System Connect services are available for the brands and companies of Erwin Hymer Group SE listed therein, insofar as those vehicles are compatible with these services.
The exact designation of the App and the Cloud Service depends on the brand or company of the respective vehicle in accordance with clause 16.2 of the Terms of Use in their current version.
In connection with the use of the System Connect services, data relating to you and your vehicle is processed by Erwin Hymer Group SE. The collection of this data makes it possible to identify and rectify any functional faults in a targeted manner.
Joint "Controllers" are the parties that collect, process or use personal data (e.g. names, e-mail addresses or similar).

All contractual documents and information necessary for your use of the System Connect service are held on our behalf by the respective brands and companies of Erwin Hymer Group SE — specifically the company that is the owner of your vehicle's brand (see section 1 above). In this way, all documents relating to the use of the vehicle are held by the company of your vehicle's brand. An overview of all vehicle brands, service designations and the associated companies is available in clause 16 of the Terms of Use.
Pursuant to Art. 26(3) GDPR, you have the right to exercise your data subject rights against any controller.
With regard to the provision of the System Connect services, Erwin Hymer Group SE is the responsible controller. You may exercise your rights pursuant to Arts. 15 et seq. GDPR by e-mail to privacy@erwinhymergroup.com. In addition, you may also exercise your rights with our subsidiaries (associated with your vehicle brand). The contact details can be found in the respective privacy notices of those companies.

The System Connect Terms of Use of Erwin Hymer Group SE apply to the provision of the System Connect service. We enter into these Terms of Use with you when you purchase a vehicle fitted with an SCU (or an SCU retrofit kit for your vehicle) and when you create a user account in the System Connect Cloud (conclusion of contract and creation of a user account in accordance with clause 2 of the Terms of Use), or when you commission an SIU in your vehicle.
The System Connect services enable you either to control components and services contained in the vehicle (SCU) or to retrieve information from sensors in the vehicle that are connected to the System Connect service (SIU).
In addition, when using the System Connect App, the aforementioned functions can also be used via a mobile device.

The SCU and the SIU are connected to various components of the vehicle. With both versions, you can retrieve various information from your vehicle's sensors.
With the SCU, you can execute functions in the vehicle in a coordinated manner. This gives you the option of viewing the current status of your vehicle or making settings, for example to the heating/air conditioning.
In this process, data is transferred mutually between the SCU and the System Connect Cloud in order to provide the System Connect services for your vehicle.
Via this data exchange, you can also use the System Connect service with the help of the System Connect App on your smartphone and control various functions of your vehicle. You can optionally obtain this App for smartphones or tablets from the App Stores of the respective store operators.

Our App is designed to optimise your experience with your vehicle. In order to provide you with the driving experience and our services with maximum convenience, the App gives you direct access to a wide range of your vehicle's functions.
We automatically store access data (so-called log files) with every use of our App, such as the name of the internet service provider, the operating system used, the date and duration of the visit, and, for security reasons — for example to detect attacks on our App — the IP address of the device used, for a period of 7 days.

The System Connect App is offered in the App Stores of the respective store operators. When opening the App for the first time, you will be prompted to conclude the EULA with us. Upon confirming the EULA, you will be able to use our App.
In order to document your confirmation of the EULA, we store the following data about you or your device. This serves to ensure that you are entitled to use our service in accordance with the EULA.

Our App can be used without actively providing personal data. After starting the App, the so-called Demo Mode is available to you. This mode gives you the opportunity to simulate the operating options of a vehicle. The available control functions are displayed to you.

As an App user, you can also add a vehicle that does not have an SCU/SIU via the registration process. Using this function, you have the option, for example, to record key information about your vehicle, upload personal content and vehicle-related data, and store vehicle-specific information (such as reminders for workshop visits or servicing). By storing this information, direct contact can be established with us and/or the specialist dealer. In this process, we process data from your user account in conjunction with your vehicle data. This data is stored in the respective applications/services from Appendix 1 of the controller.

As an App user, you can set up a user account via the registration process. In doing so, we collect data about you that is required to create a user account. This data is stored in the respective applications/services from Appendix 1 of the controller.
To verify your identity, you will receive an e-mail to the e-mail address you have provided during the registration process, including a link for confirmation.
After confirming the link, you will be prompted to set a password for your account.

After completing registration, you have the option of linking your user account to a vehicle (see clause 2.2.6 Primary User).

There is exclusively one fixed primary user for each vehicle (subject to the creation of a user account). The primary user registered during pairing is always the owner of a vehicle equipped with an SCU, or the person authorised by the owner to use the vehicle with the System Connect service as primary user.
As primary user, you have the option of enabling further users (co-users) to use the System Connect services. You can revoke these permissions at any time or deactivate co-users.

In accordance with clause 4.3 of the Terms of Use, the primary user may also permit other persons to use the System Connect services for their vehicle.
These co-users may use those functionalities of the System Connect service that the primary user has enabled for the co-user. This activation is carried out by sharing/releasing a QR code created in the App, which must be scanned by the co-user's device.
The primary user may revoke the user rights granted to the co-user at any time. A co-user's rights are automatically revoked if the primary user deactivates their user account or dissolves the link to the vehicle in question.

Transmission of your vehicle's position and processing of this data only takes place from the moment you decide to use this function and have activated it. Activation of the service can only ever be carried out by the primary user.
Once the service has been activated by the primary user, you as primary user or co-user with the associated permission have the option of viewing the most recently reported vehicle location.
All registered users have the option of viewing the location of the vehicle. It is not necessary for users to be in the immediate vicinity of the vehicle for this purpose.

In the App, it is possible for you to view places in the vicinity — such as dealers or workshops — on a map (so-called Points of Interest – "POI").

When first starting the App, you will be asked whether you would like to receive push notifications on your device.
If you activate this, you will have the option of being informed about certain events or information from the devices connected to the SCU, or of registering for the newsletter or further marketing activities. You can select the type and scope of push notifications yourself.
You can manage your notification settings yourself and decide which push notifications you would like to receive on your device.

Please note that not all brands in our group provide newsletters. The following information therefore only concerns brands that offer a newsletter.
On our online offering, users have the opportunity to subscribe to our newsletter or any notifications via various channels (hereinafter "newsletter"). We only send newsletters in accordance with statutory provisions to recipients who have consented to receiving the newsletter. We use a selected service provider for sending our newsletter. The consent you have given in the App for the newsletter is transmitted by Erwin Hymer Group SE to the respective brand whose newsletter you have subscribed to.
To subscribe to a newsletter from us, the provision of an e-mail address is required. Where applicable, we collect additional data, such as a name, in order to address our newsletters personally.
Our newsletter is only sent once the toggle is activated. You can unsubscribe from our newsletter at any time for the future by deactivating the toggle for the newsletter subscription. In addition, an unsubscribe link (opt-out link) is included at the end of each newsletter.
We are also obliged to maintain evidence that our subscribers actually wished to receive the newsletter. For this purpose, we collect and store the time of subscription and unsubscription in the customer account.
Our newsletters are designed in such a way that it is possible for us to gain insights into improvements, target groups or the reading behaviour of our subscribers. This is made possible by a so-called web beacon or counting pixel, which responds to interactions with the newsletter — for example, whether links are clicked, whether the newsletter is opened at all, or at what time the newsletter is read. For technical reasons, we are able to assign this information to individual subscribers.

In order to continuously improve the user-friendliness and design of our App, we use analytics services.
For this purpose, we collect information about the behaviour, interests or demographic information of our visitors, such as country settings, language used, and similar data. This helps us to identify at what times our App, its functions or content are most frequently visited or invite repeated use. In addition, the information collected allows us to determine whether our App requires optimisation or adjustment.
As a rule, however, no clear-text user data is processed for the purposes described. In this case, the data is altered in such a way that the actual identity of users is not known to us. In particular, IP addresses are anonymised, which therefore prevents identification of your person.
As a tool, we use the service Google Analytics for Firebase, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Firebase Analytics uses the advertising ID stored on your device. You can change or deactivate this in the device settings of your mobile device.

In order to improve functions and services, and for further development and quality assurance, we analyse usage and error data from the System Connect Unit and compile these into statistics. This data is collected and processed by us in anonymous form and therefore does not allow any conclusions to be drawn about you or your vehicle.
In the context of using the System Connect services, vehicle data is processed and stored by Erwin Hymer Group SE in the System Connect Cloud. The processing of this data enables us to provide you with the System Connect service and to identify and rectify any functional faults in a targeted manner.
Your data is only passed on to external parties within the EU
We will not pass on your data to third parties beyond this. Insofar as we engage service providers within the scope of commissioned processing, your data there is subject to the same security standards as with us. In all other cases, recipients may only use the data for the purposes for which it was transferred to them.
We transfer data to countries outside the EEA (so-called third countries). This is carried out for the purposes stated above.
In the event that we transfer data to a country outside the EEA for the purpose of processing, we ensure that the processing is legally permissible in the manner we have envisaged. For this purpose, we have concluded standard data protection clauses including a separate arrangement of appropriate technical and organisational measures in order to protect the data of data subjects as effectively as possible. A copy of the guarantees used can be obtained from the overview of recipients in Appendix 1.
We store your personal data as a matter of principle for as long as this is required to provide our service, or insofar as this has been provided for by the European legislator or another legislator in laws or regulations applicable to us. In all other cases, we delete your personal data or remove the personal reference after the purpose has been fulfilled, with the exception of data that we must continue to store in order to fulfil legal obligations (e.g. due to tax and commercial law retention periods, we are obliged to retain documents such as contracts and invoices for a certain period).
Information about you that can be assigned to your contract will be deleted immediately upon expiry of the contract/upon termination.
The contractual documents and other records will be deleted after expiry of the statutory retention period of 10 years.
When the SCU is paired with the System Connect Cloud, a log is created which is stored for the duration of use of these functions. This pairing log serves to correctly assign the components to a particular vehicle.
Via the conclusion of the contract referred to in clause 2.2.1, a personal reference to the respective purchaser of the new vehicle or the SCU retrofit kit can be established via the pairing log. This personal reference remains assigned to your vehicle until the end of the contract, or until the end of the aforementioned retention period. Once the data is deleted in accordance with clause 3.3.1, the personal reference of the pairing log also ceases.
Upon expiry of the System Connect service for your vehicle, or upon withdrawal from the Terms of Use, the connection between the SCU (your vehicle) and the System Connect Cloud will be severed, in accordance with clause 7.2 of the Terms of Use.
The dynamic usage and error data is continuously overwritten in the internal memory. Furthermore, this usage data is transmitted to the System Connect Cloud in accordance with the Terms of Use. Transmission takes place for as long as this is required for the performance of the contract. Once the contract pursuant to clause 2.2.1 ends, no further data will be transmitted from the SCU to the System Connect Cloud. Data transmitted up to that point will be anonymised upon expiry of the contract. It is therefore no longer possible to draw conclusions about your identity.
You have the option of deleting your user account yourself within the App at any time. You can delete your user account in the "My Profile" section via "Delete Account". Upon confirmation, the data from your registration will be deleted. This function is available to both primary users and co-users.
If you delete your user account, the connection between the App and the vehicle will also be severed.
In our App, we offer the option of contacting us directly or obtaining information about various contact options. In order to maintain an overview of all communications with us at all times, we use the ticketing system of the provider Zendesk Inc., 989 Market Street #300, San Francisco, CA 94102, USA, for processing corresponding enquiries.
In the event of contact being made, we process the data of the enquiring person to the extent required for answering or processing the enquiry. Depending on the channel through which contact is made with us, the data processed may vary.

We do not use purely automated decision-making procedures pursuant to Art. 22 GDPR. Should we use such a procedure in individual cases in the future, we will inform you separately about this, insofar as this is required by law.
In the context of pre-contractual relations, you must provide those personal data that are required for the establishment, execution and termination of the legal transaction and the fulfilment of the associated contractual obligations, or that we are legally obliged to collect. Without this data, we will not be in a position to carry out the legal transaction with you.
The provision of your data is necessary in order for us to provide you with our System Connect service in the manner in which we offer and commit to in our System Connect Terms of Use and in our EULA.
Erwin Hymer Group SE employs technical and organisational security measures to protect the data managed by us against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security measures are continuously improved in line with technological developments.
Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we have obtained consent for a specific processing purpose.
If the processing of personal data is necessary for the performance of a contract to which the data subject is a party — as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of any other service or consideration — the processing is based on Art. 6(1)(b) GDPR. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of enquiries about our products or services.
If we are subject to a legal obligation which requires the processing of personal data, such as for the fulfilment of tax obligations, the processing is based on Art. 6(1)(c) GDPR.
If the processing of personal data is necessary in order to protect the vital interests of the data subject or of another natural person, the processing is based on Art. 6(1)(d) GDPR.
Finally, processing operations may be based on Art. 6(1)(f) GDPR. Processing operations are based on this legal basis if the processing is necessary for the purposes of the legitimate interests pursued by us or by a third party, provided that the interests, fundamental rights and fundamental freedoms of the data subject do not override those interests.
